Terms of Service

These Terms govern your use of Tricollo (the "App"), provided by Tricollo. By creating an account or using the App, you agree to these Terms. If you don't agree, please don't use the App.

Where you've downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Tricollo only, not Apple, and that Apple has no obligation to provide any maintenance or support for the App. Apple is not responsible for any product liability claims, claims that the App fails to meet applicable legal or regulatory requirements, or claims arising under consumer protection law relating to the App. Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce them against you.

Tricollo is a personal, encrypted storage app with an optional feature that shares access to specific files with a person you choose, if you stop checking in for an extended period.

Tricollo is not a will, a legal instrument, or a substitute for estate planning, and does not grant any legal authority over your affairs. It only controls access to the digital files you explicitly place in a vault. For anything with legal weight, please consult a qualified professional.

You must be at least 16 years old, and legally able to enter into this agreement in your jurisdiction, to use Tricollo. By using the App, you represent that you meet these requirements.

• You're responsible for keeping your device and account credentials secure.
• You're responsible for choosing trusted contacts you genuinely trust, since they're the people your vault can be passed on to.
• Tell us right away at support@tricollo.com if you believe your account has been compromised.
• One account per person; accounts may not be shared or transferred.

You keep all rights to the files you store in Tricollo. Because they're encrypted on your device before upload, we don't take any license to view, analyze, or use your vault contents, and we have no technical ability to do so. We only ever process the resulting ciphertext to store and transmit it back to you (or, if a handoff genuinely occurs, to your trusted contact) on your instruction.

You're solely responsible for making sure you have the right to store and share any content you add to a vault, including content you plan to make accessible to a trusted contact.

You control your check-in schedule and who your trusted contact is. Tricollo passes on vault access only after the missed-check-in threshold you configured is reached, following the process described in the app. You can change your trusted contact, your schedule, or disable the feature at any time, and nothing is passed on outside that process.

Tricollo's encryption is designed so that no one, including us, can read your vault without the right key material. That same design means we cannot recover your data if you permanently lose access to your device and your configured recovery options. Set up and safeguard your recovery method carefully, and keep independent backups of anything you can't afford to lose. Your use of the App, and the risk of data loss that comes with true end-to-end encryption, is at your own discretion.

You agree not to:

• use Tricollo to store or distribute unlawful content;
• attempt to reverse-engineer, decompile, or bypass the App's security or encryption;
• interfere with or disrupt the service or its infrastructure;
• use the App to violate the rights of any third party, including your trusted contacts.

We reserve the right to suspend or terminate accounts that violate this section, to the extent we're able to detect it without access to your encrypted content.

Subject to your compliance with these Terms, we grant you a personal, revocable, non-exclusive, non-transferable license to install and use the App on devices you own or control, solely for its intended purpose. All rights not expressly granted are reserved by Tricollo and its licensors. This license terminates automatically if you breach these Terms.

Tricollo Pro is an auto-renewing subscription, billed monthly or yearly through your Apple ID. When you subscribe:

• payment is charged to your Apple ID account at confirmation of purchase;
• subscriptions automatically renew for the same duration unless auto-renew is turned off at least 24 hours before the end of the current period;
• any renewal fee is charged within 24 hours before the end of the current period;
• you can manage or cancel your subscription any time in your Apple ID account settings;
• any unused portion of a free trial, where offered, is forfeited when you purchase a subscription.

Prices may vary by region and are subject to change; we'll give you notice before any change takes effect for your subscription.

If you're a consumer in the EU or UK, you generally have a 14-day right to withdraw from a distance contract without giving a reason. Because Apple is the merchant of record for App Store subscription purchases, withdrawal, refund, and cancellation requests for those purchases are handled through Apple's own refund process rather than directly by us. By starting to use a paid feature immediately after purchase, you acknowledge that your withdrawal right may be affected once the service has been fully performed, consistent with Apple's terms.

You can delete your account at any time from within the app. We may suspend or terminate accounts that violate these Terms, misuse the service, or where we're required to by law. Sections of these Terms that by their nature should survive termination (including Sections 5, 7, 14, 15, and 16) will continue to apply.

The Tricollo name, logo, and app itself (excluding your own vault content) are owned by Tricollo or its licensors. Nothing in these Terms transfers any of that intellectual property to you beyond the limited license in Section 9.

Tricollo is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that it will meet your specific requirements. Some jurisdictions don't allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

To the fullest extent permitted by law, Tricollo and its officers, employees, and licensors won't be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the App, including data loss resulting from lost device access or forgotten recovery information as described in Section 7. Where liability can't be excluded, it's limited to the amount you paid us in the 12 months before the claim arose.

You agree to indemnify and hold Tricollo harmless from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the App.

These Terms are governed by the law applicable at Tricollo's place of business, without regard to conflict-of-law principles, except where local consumer protection law requires otherwise for consumers residing elsewhere. Any dispute not resolved informally by contacting support@tricollo.com will be subject to the courts with jurisdiction over that location, unless mandatory law in your place of residence gives you the right to bring it elsewhere.

We may update these Terms from time to time. Material changes will be communicated in the app or by email before they take effect. Continuing to use Tricollo after a change takes effect means you accept the updated Terms.

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy, make up the entire agreement between you and Tricollo regarding Tricollo.
